Regulation
The Charities Act 2009 was enacted on the 28th February but will only come into force when the Minister signs commencement orders for the individual provisions and sections. The Minister, John Curran TD has indicated that there is a considerable body of work to be undertaken in preparation for statutory regulation and that it could be up to two years before all the provisions are fully implemented. When the Act comes into force, charities will have to:
- Register with a new Charity Regulator
- Provide annual reports and annual financial returns to the Charity Regulator
- Obtain permits for all types of fundraising
- Give details of fundraising activity and expenditure in annual accounts
- Follow agreed Codes of Practice for fundraising from the public
ICTRG has always supported the introduction of regulation and best practice. In fact, we have taken an active role in shaping the new legislation to accommodate the needs of Irish charities and to underpin public confidence in the sector. We will continue to monitor developments throughout the implementation phase, and keep our members informed of the changes that will affect them. In addition, ICTRG will help charities to prepare for the new regulations and support them during the implementation phase of both the Charities Act 2009 and the Fundraising Codes of Practice.
